1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and VisaApt ("Company," "we," "us," or "our") governing your use of our visa appointment monitoring service.

By accessing or using VisaApt, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our service.

IMPORTANT: These Terms contain an arbitration clause and class action waiver. Please read Section 16 carefully.

2. Eligibility

To use VisaApt, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our service under applicable law
• Provide accurate and complete registration information
• Maintain the security of your account credentials

3. Description of Service

VisaApt is a monitoring service that automatically checks visa appointment systems for available slots matching your specified criteria. We provide notification when appointments are found.

3.1 Service Features

• 24/7 automated monitoring of appointment availability
• Email and WhatsApp notifications when appointments are found
• Priority-based processing according to bid amount
• Success-based billing (charged only when appointments are found)

3.2 Service Limitations

Our service is subject to the following limitations:

• We monitor appointment systems but do not control availability
• We cannot guarantee that appointments will be found
• We are not responsible for changes to government appointment systems
• Appointment slots may be taken by others before you can book them
• Service availability may vary by country and visa type

4. User Accounts

4.1 Account Registration

You may create an account by:

• Direct registration with email and password
• Signing in with your Google account (Google OAuth)

Regardless of registration method, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Keep your password secure and confidential (for direct registration)
• Maintain the security of your Google account (for Google Sign-In)
• Notify us immediately of unauthorized account access
• Accept responsibility for all activities under your account

4.1a Google Sign-In

When you sign in with Google:

• You authorize us to access your Google email and basic profile information
• Your use is subject to Google's Terms of Service and Privacy Policy
• You can revoke our access at any time via your Google Account settings
• We are not responsible for Google's authentication service availability
• You remain responsible for maintaining your Google account security

We only request the minimum necessary permissions (email and basic profile). We do not access your Gmail, Drive, Calendar, or other Google services.

4.2 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Provide false or misleading information
• Engage in fraudulent activity
• Abuse or misuse our service
• Fail to pay amounts owed

5. Bidding and Pricing

5.1 Bid Placement

When you create an appointment request:

• You set a bid amount between the minimum and maximum allowed
• Higher bids receive priority in processing
• Bids are binding commitments to pay if we find an appointment
• You authorize us to charge your payment method upon success

5.2 Pricing Tiers

Suggested pricing tiers (you may bid any amount within allowed range):

• Standard: $99-$149
• Priority: $150-$299
• Express: $300-$999

5.3 Dynamic Pricing

We may adjust minimum bid amounts based on demand, location, or other factors. Current minimums are displayed when creating requests.

6. Payment Terms

6.1 Payment Authorization

By providing payment information:

• You authorize a pre-authorization hold on your payment method
• You agree to be charged when we find a matching appointment
• You confirm that you are authorized to use the payment method
• You agree to pay all applicable fees and taxes

6.2 When Charges Occur

You will be charged your bid amount when:

• We find an appointment matching your criteria
• The appointment is verified as available
• We send you notification with appointment details

No appointment found = No charge. If we never find a matching appointment, you are never charged.

6.3 Payment Processing

All payments are processed securely through Stripe. We do not store your full payment card details. Failed charges may result in request cancellation.

6.4 Taxes

Prices do not include applicable sales tax, VAT, or other taxes, which will be added where required by law.

7. Refunds and Cancellations

7.1 Before Appointment is Found

You may cancel your request at any time before we find an appointment. No charge is processed, and any pre-authorization hold is released.

7.2 After Appointment is Found

Once we find an appointment and charge your payment method:

• No refunds are provided
• The charge is final and non-refundable
• The appointment was valid at the time of notification
• We have fulfilled our service obligation

7.3 Exceptions

Refunds may be issued at our sole discretion in exceptional circumstances:

• Technical errors resulting in incorrect charges
• System failures preventing appointment notification delivery
• Duplicate charges for the same appointment

Refunds are NOT provided because:

• The appointment was taken before you could book it
• You changed your mind after receiving notification
• You decided not to pursue the visa application
• Government appointment system issues

8. Discounts and Promotions

8.1 Volume Discount

Users receive a 30% discount after successfully completing 3 paid appointments through our service.

8.2 Affiliate Program

Our affiliate program offers:

• 20% commission on successful referral appointments
• Minimum payout threshold of $50
• Monthly payment processing
• Compliance with affiliate program terms (separate document)

9. Prohibited Conduct

You agree NOT to:

• Use the service for any illegal purpose
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Attempt to bypass payment or authentication systems
• Reverse engineer or decompile the service
• Use automated tools to access the service (except as intended)
• Share account credentials with others
• Create multiple accounts to circumvent restrictions
• Interfere with service operations or infrastructure
• Engage in fraudulent activities or chargebacks

10. Intellectual Property

All content, features, and functionality of VisaApt are owned by us and protected by copyright, trademark, and other intellectual property laws. You are granted a limited license to use the service for personal, non-commercial purposes.

You may not copy, modify, distribute, sell, or lease any part of our service without express written permission.

11. Disclaimers and Limitations of Liability

11.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of uninterrupted or error-free operation
• Warranties that appointments will be found
• Warranties regarding third-party appointment systems

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Indirect, incidental, consequential, or punitive damages
• Lost profits, revenue, data, or business opportunities
• Appointment slots taken before you could book them
• Changes to government appointment systems
• Service interruptions or technical issues
• Third-party actions or failures

Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

11.3 No Guarantee of Results

We do not guarantee that appointments will be found or that you will successfully book an appointment. Appointment availability is controlled by government systems beyond our control.

12. Indemnification

You agree to indemnify, defend, and hold harmless VisaApt, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service, violation of these Terms, or infringement of any rights of others.

13. Third-Party Services

Our service integrates with third-party services:

• Google OAuth: For Google Sign-In authentication
• Stripe: For payment processing
• Email providers: For transactional notifications
• WhatsApp (Twilio): For WhatsApp notifications
• Analytics providers: For service improvement

Your use of these services is subject to their respective terms and privacy policies:

We are not responsible for the availability, functionality, or policies of third-party services.

14. Modifications to Service and Terms

We may update these Terms at any time. Material changes will be communicated via:

• Prominent notice on our website
• In-app notification

Continued use after changes constitutes acceptance of updated Terms.

15. Governing Law and Jurisdiction

16.3 Class Action Waiver

YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS-WIDE ARBITRATION.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and VisaApt.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

17.3 Waiver

Failure to enforce any right or provision does not constitute a waiver of that right or provision.

17.4 Assignment

We may assign these Terms at any time. You may not assign your rights or obligations without our written consent.

17.5 Force Majeure

We are not liable for delays or failures caused by circumstances beyond our reasonable control.
